Petition Demanding BxD Union Member Reinstatement

TO THE BRONX DEFENDERS:

We, the undersigned members and allies of UAW Local 2325 – the Association of Legal Advocates and Attorneys, stand united in outrage at the Bronx Defenders’ decision to suspend Sophia Gurulé without pay. We stand with her coworkers in demanding her immediate reinstatement with full back pay and benefits. 

Sophia is a long-serving, deeply respected immigration attorney and dedicated union leader. She has fearlessly spoken out on issues where silence was expected—from opposing the occupation of Palestine to fighting immigration detention and mobilizing against management’s mistreatment of workers. Her consistent stance on the interconnected struggle for collective liberation makes her a critical voice that challenges the silence, intimidation, and complicity that the Trump administration is eager to maintain.

The extreme measures against Sophia come amidst a practice in collapse. For over a year, the Immigration Practice at the Bronx Defenders has suffered from chronic mismanagement, a funding crisis, and crushing caseloads. No Fall 2024 training team was hired, and in November, management laid off critical social workers and an Immigration Civil Legal Advocate. Entering 2025, the practice was already underwater. 

Reassigned in full to New York Immigrant Family Unity Project (NYIFUP) after her Policy Team layoff, Sophia received no updated training despite a drastically changed landscape: virtual courts, new detention centers, and sweeping legal changes. NYIFUP attorneys now carry five to nine detained clients along with other non-detained and affirmative cases—without the supervision, training, or resources repeatedly requested. When staff asked for support, the Managing Director belittled them and, in response to Trump’s election, recommended that they “book their PTO now.” Meanwhile, 1,000 new detention beds have opened in Newark and ICE kidnappings are now happening in the already hostile courtrooms where NYIFUP public defenders advocate to stop deportations. 

Sophia was thrown into this crisis without the support every worker deserves. Then, after failing to meet the unreasonable expectations of hostile judges newly emboldened to facilitate rapid, mass deportations by any means necessary, her employer — a public defender organization based in the Bronx — decided to fixate its limited resources on investigating and not paying Sophia rather than managing a workload crisis that has been escalating since 2019, the last year the New York City Council increased funding for NYIFUP. Notably, management in the BxD Immigration practice has credited Sophia for helping secure increased funding for all three NYIFUP organizations in 2019 after the then City Council Speaker and Immigration Committee Chairperson observed one of her court appearances.

To blame any alleged shortcomings solely on Sophia, rather than this systemic collapse at The Bronx Defenders, is disingenuous, dishonest, and dangerous. Suspending a senior attorney under these conditions is sabotage—it disrespects workers, harms clients, and throws a community into chaos. 

This is not a one-off decision—it is part of a coordinated attack on active union members, and part of a larger pattern of hostile and unlawful retaliation against union members who have spoken out against mistreatment. The Bronx Defenders’ intent is obvious: to chill organizing, punish dissent, and send a message that those who challenge mismanagement and who speak up for their communities will be made an example of.

Let this be our response: we are all Sophia Gurulé. If you thought this would happen quietly, you miscalculated. This has mobilized the full force of UAW Local 2325. We are ready to descend on The Bronx Defenders—at your offices, to your funders, and in public view. We will not allow one of our own to be targeted for doing what this organization claims to support: fighting for equity and justice.

We are putting you on notice. Reinstating Sophia immediately is the bare minimum first step. Failure to do so will escalate this conflict far beyond a grievance—it will become a union-wide, public fight over the future of this workplace and the rights of every employee at The Bronx Defenders.

June 10, 2025 Update:

On May 20, the Union filed a grievance against the Bronx Defenders’ May 19 decision to place her on “unpaid suspension pending investigation” in violation of multiple sections of the Union and Bronx Defenders’ collective bargaining agreement, including but not limited to just cause. 

On June 2, the Union filed an unfair labor practice (ULP) charge against the Bronx Defenders for violating the NLRA by “(1) unlawfully disciplining Sophia Gurulé for engaging in protected, concerted activity including but not limited to activities as a union representative, protesting unfair terms and conditions of employment, and filing and pursuing a grievance and demand for arbitration regarding her improper layoff/transfer; and (2) unlawfully interfering with Gurulé’s right to engage in protected, concerted activity, including but not limited to talking to her co-workers about the circumstances of her discipline.”

Shortly thereafter, and due to BxD Union workers organizing an emergency general body meeting, petitions, and direct email actions in Sophia’s defense, Bronx Defenders committed to converting Sophia’s “unpaid suspension pending investigation” into a paid suspension, including backpay, pending investigation.

On Friday, June 6, the Bronx Defenders successfully adhered to their commitment by paying their employee, Sophia Gurulé, on time. The uncertainty of the Bronx Defenders fulfilling this commitment is not a joke, though it certainly has to make you laugh given the investigation’s scope concerns Sophia’s “overall diligence” and “overall preparedness”. Throughout its investigation, the Bronx Defenders has repeatedly failed to meet its own internal deadlines to respond to the Union’s May 20, 2025 grievance and RFI related to this suspension as well as failed to provide Sophia with the case files, case management and communication systems she needs so she may respond substantively to the investigatory charges against her and specifically the sole investigatory question: “What information can you offer to explain your failure to take the indicated actions with respect to each of these clients?”

Due to their failure to provide full access and to substantively respond to the Union’s grievance and RFI, the Bronx Defenders’ investigation remains pending and unresolved since Monday, May 19th, a day which should be celebrated for the birthdays of Yuri Kochiyama, Lorraine Hansberry, Ho Chi Minh, and Malcom X’s 100th birthday yet here we are talking about Sophia Gurulé instead.

The Union is prepared to file a ULP charge against the Bronx Defenders on Monday, June 16 if there is not a substantive response to the Union’s May 19th Grievance and RFI.

Notably, prior to issuing an unpaid suspension pending investigation, Sophia was never disciplined in her nearly 8 years at BxD. Her performance evaluations consistently describe her as an ‘outstanding attorney’ “exceeding expectations” who has “a lot of experience that the [Immigration] practice could learn from.” Since the Bronx Defenders first unionized amidst the 2020 uprisings, Sophia has held multiple union roles: a member of the BxD Union first bargaining committee (2020-2022), BxD Union VP of Membership (2023), a member of the BxD Union’s second bargaining committee (2024), as well as ALAA-UAW Local 2325 trustee and BxD Union executive board member (2024-present). She also has a pending arbitration with the Bronx Defenders regarding BxD’s transfer/layoff of Sophia from the Immigration Policy Counsel position she held since 2019.
